Terms of Sale

These Terms of Sale (“Terms”) govern all purchases of photographic prints, wall art, albums, products,

digital products, and other items purchased from Vibe + Light Photography (“Photographer,” “Vibe + Light,”“we,” “us,” or “our”) through our Pixieset Store.

By placing an order through our online Store, you (“Client,” “you,” or “your”) acknowledge that you haveread, understood, and agree to these Terms of Sale. These Terms are incorporated into and form part ofyour purchase agreement with Vibe + Light Photography.

1. Products and Services
Vibe + Light Photography offers photographic prints and other products that may be produced byprofessional photographic laboratories and specialty product vendors selected by the Photographer.
Product availability, sizes, finishes, materials, colors, and pricing are subject to change without notice.Changes will not affect an order that has already been accepted and paid for, except where correction of anobvious error is necessary.
Because photographic products are individually produced, minor variations in color, density, contrast, cropping, texture, and appearance may occur between the image displayed on a computer, tablet, or mobile device and the final printed product.
Such variations are considered normal characteristics of photographic reproduction and are not necessarilyconsidered defects.

2. Ordering and Acceptance
Your order is an offer to purchase the selected products under these Terms.
An order is considered accepted when payment has been successfully processed and the order has beensubmitted for production.
Vibe + Light Photography reserves the right to decline or cancel an order when reasonably necessary,including because of an obvious pricing, product, image-resolution, technical, or availability error.
If we cancel an order after payment has been received, you will receive a refund of the amount actually paidfor the cancelled order.

3. Pricing and Taxes
All prices displayed in the Store are subject to applicable sales tax and other legally required charges.
Applicable taxes will be calculated and added to your order as required by law.
Prices are subject to change; however, the price displayed and accepted at the time your order is placed will
generally apply to that order.

4. Payment
Payment must be received in full before an order is submitted for production.
Vibe + Light Photography does not begin production of unpaid orders.
Payment processing may be handled by third-party payment providers made available through Pixieset.
Vibe + Light Photography does not receive or retain your complete payment-card information.

5. Production and Fulfillment
Products may be fulfilled directly by Vibe + Light Photography or by a professional photographic laboratory
or product vendor selected by the Photographer.
Where a third-party laboratory is used, the Photographer remains your point of contact for questions or
concerns regarding your order.
Because many photographic products are produced specifically for the Client after an order is placed,
products may not be returned simply because the Client changes their mind, ordered the wrong size, no
longer wants the product, or does not like the appearance of a properly produced product.

6. Returns, Exchanges, and Refunds
All photographic products are considered final sale except as provided below.
Because prints, enlargements, wall art, albums, and other photographic products are custom-produced
using the Client's selected image, size, finish, and product specifications, Vibe + Light Photography does not
generally accept returns or exchanges for:
Change of mind;
Incorrect product selection by the Client;
Incorrect size selected by the Client;
Personal preference regarding color, contrast, cropping, or appearance;
Failure to review product selections before ordering; or
Products that conform to the order but differ slightly from the appearance of the image on a
computer or mobile screen.
This policy does not limit any rights or remedies that cannot lawfully be waived.

7. Damaged, Defective, or Incorrect Products
We want you to be happy with your photographic products.
If your order arrives damaged, defective, materially different from what you ordered, or contains the wrong
product or image, please contact Vibe + Light Photography as soon as reasonably possible and preferably
within 30 days of delivery.
Please provide:
Your name and order information;
A description of the problem; and
Clear photographs of the product and packaging when applicable.
If the product is determined to have been damaged in transit, materially defective, or incorrectly produced
or fulfilled, Vibe + Light Photography will work with the appropriate laboratory or vendor to determine an
appropriate remedy, which may include a replacement or refund.
A replacement product may be offered rather than a refund when reasonably appropriate.
Nothing in these Terms is intended to exclude any consumer rights or remedies that cannot legally be
excluded.

8. Shipping and Delivery
Shipping charges, if applicable, will be displayed during checkout.
Estimated production and delivery times are estimates only and are not guaranteed unless expressly stated
otherwise in writing.
Once an order has been shipped, delays caused by the postal service, courier, weather, natural disaster,
transportation interruption, incorrect address information supplied by the Client, or other circumstances
outside the Photographer's reasonable control are not considered production defects.
The Client is responsible for providing an accurate and complete shipping address.
If an order is returned because of an incorrect or incomplete address supplied by the Client, additional
shipping charges may apply before the order can be reshipped.
If a package appears to be lost or substantially delayed, please contact Vibe + Light Photography so that we
can assist in investigating the shipment.

9. Review of Orders
Clients are responsible for reviewing their order before submitting it, including:
Product type
Product size
Quantity
Finish or material
Shipping address
Other available product selections
Once an order has entered production, changes or cancellations may no longer be possible.

10. Cropping and Image Presentation
Some print sizes and products require an image to be cropped to fit the selected dimensions.
The Photographer may make reasonable cropping adjustments necessary to produce the selected product.
Clients should review any available product preview before placing an order.
The final product may vary slightly from an on-screen preview because of differences in display technology,
paper, ink, printing process, lighting, and other factors.

11. Artistic Style and Color
Photography is an artistic service, and photographic reproduction is subject to variations in color and
appearance. Vibe + Light Photography makes reasonable efforts to produce prints consistent with the Photographer's
artistic style and the selected image. Differences in monitors, phones, tablets, browsers, lighting conditions, paper surfaces, printing processes, and inks may result in differences between an on-screen image and a physical print.
Minor variations do not necessarily constitute a defect.

12. Copyright
All photographs created by Vibe + Light Photography remain protected by applicable copyright law.
Purchase of a print, album, wall product, or other physical product does not transfer copyright ownership
to the Client.The Client receives ownership of the physical product purchased, but Vibe + Light Photography retains
copyright and all rights not expressly granted in writing. The Client may not reproduce, scan, copy, sell, license, distribute, or commercially exploit a physical photograph except as expressly permitted in writing or by applicable law.
Digital-image purchases are governed separately by the Vibe + Light Photography Digital Image License.

13. Personal Use
Unless otherwise agreed in writing, photographic products purchased through the Store are intended for
the Client's personal use.
Commercial, advertising, promotional, resale, publication, or other commercial use of photographs requires
a separate written license from Vibe + Light Photography.

14. Force Majeure
Vibe + Light Photography will not be responsible for delay or failure to perform caused by circumstances
beyond our reasonable control, including natural disasters, severe weather, fire, power failure, internet or
technology failures, labor disruptions, transportation interruptions, government action, illness, or failures
of third-party vendors. If such circumstances materially affect an order, we will make reasonable efforts to communicate with the
Client and provide an appropriate solution.

15. Limitation of Liability
To the fullest extent permitted by applicable law, Vibe + Light Photography's liability relating to a particular
product purchase will be limited to the amount actually paid by the Client for the affected product or order.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

16. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
Any dispute arising from a purchase shall be handled in accordance with applicable Michigan law and the
jurisdiction of courts having proper authority.

17. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be
limited or removed to the minimum extent necessary, and the remaining provisions will continue in full
force and effect.

18. Changes to These Terms
Vibe + Light Photography may update these Terms from time to time. The Terms applicable to a purchase are the Terms presented to the Client at the time the order is placed.

19. Agreement
By clicking “Place Order” and completing a purchase through the Vibe + Light Photography Store, you
acknowledge that you have had the opportunity to review these Terms of Sale and agree to be bound by
them.
