Website & Client Gallery Terms of Service

Welcome to Vibe + Light Photography.

These Terms of Service (“Terms”) govern your use of the Vibe + Light Photography website, online galleries, client galleries, and related digital services (“Services”).

By accessing or using our website or Client Gallery, you acknowledge that you have read, understood, and agree to these Terms.

1. Photographer and Website Owner

The website, galleries, photographs, written content, graphics, logos, branding, and other materials provided by Vibe + Light Photography are owned by or licensed to Vibe + Light Photography and are protected by applicable intellectual property laws.

2. Client Gallery Access

Client galleries may contain private photographs intended for the Client and individuals authorized by the Client.

Gallery links, passwords, download PINs, and other access credentials should be kept confidential and should not be publicly posted or distributed beyond the people the Client intends to have access to the gallery.

The Client is responsible for the security of any gallery credentials provided to them.

Vibe + Light Photography reserves the right to modify, deactivate, or remove gallery access when reasonably necessary.

3. Gallery Availability

Vibe + Light Photography makes reasonable efforts to maintain access to Client Galleries for the period communicated to the Client.

Because online galleries depend on third-party technology and hosting services, uninterrupted availability cannot be guaranteed.

Vibe + Light Photography is not responsible for temporary interruptions caused by website maintenance, technology failures, internet outages, third-party service interruptions, or circumstances beyond our reasonable control.

Clients are encouraged to download and safely back up purchased digital photographs.

4. Copyright

All photographs displayed through Vibe + Light Photography websites and galleries are protected by copyright.

Viewing, purchasing, or downloading an image does not transfer copyright ownership.

5. Use of Photographs

Photographs may not be copied, reproduced, sold, distributed, published, commercially exploited, or used for advertising without appropriate authorization.

Purchased digital photographs may be used according to the Vibe + Light Photography Digital Image License.

Physical products purchased through the Store are governed by the Vibe + Light Photography Terms of Sale.

6. Downloading and Sharing

Where downloading has been enabled, Clients may download images according to the rights granted with their purchase or gallery.

Clients may share photographs for personal purposes when authorized to do so.

Clients may not use gallery images for commercial purposes or provide high-resolution files to businesses, publications, vendors, or other third parties for commercial use without written permission.

7. Respect for Photographer’s Work

Clients agree not to intentionally alter, manipulate, distort, or use Vibe + Light Photography’s photographs in a manner that misrepresents the Photographer’s work.

Normal personal cropping and resizing are permitted when reasonably necessary for personal printing or social-media display.

8. Website Content

Vibe + Light Photography makes reasonable efforts to keep website information accurate and current.

However, product availability, pricing, portfolio content, services, galleries, and other website information may change without notice.

Photographs displayed on the website represent the Photographer’s artistic work and style but do not guarantee that every future session will look identical.

9. Third-Party Services

Vibe + Light Photography may use third-party services, including Pixieset and professional photographic laboratories, to provide website hosting, gallery delivery, payment processing, printing, product fulfillment, and other services.

Use of third-party services may also be subject to the third party’s own terms and privacy policies.

10. Privacy

Vibe + Light Photography respects the privacy of its clients.

Information submitted through the website, contact forms, galleries, ordering systems, or other services may be used to communicate with Clients, provide requested services, fulfill orders, process payments, maintain business records, and otherwise operate the business.

Personal information will be handled in accordance with Vibe + Light Photography’s applicable Privacy Policy.

11. Children’s Images

Vibe + Light Photography may photograph minors as part of family, senior, or other portrait sessions.

The Client or authorized parent/guardian is responsible for providing any required permissions and authorizations concerning the minor.

Vibe + Light Photography will handle images according to the agreements and permissions applicable to the photography session.

12. Prohibited Conduct

Users may not:

Attempt to gain unauthorized access to a gallery or account;
Circumvent security measures;
Copy or scrape website content or photographs;
Use photographs without appropriate authorization;
Interfere with website or gallery operation;
Upload malicious software or harmful material; or
Use the Services for unlawful purposes.

13. Limitation of Liability

To the fullest extent permitted by law, Vibe + Light Photography is not responsible for indirect, incidental, special, consequential, or similar damages arising from the use of the website, galleries, or third-party services.

Nothing in these Terms is intended to limit any liability that cannot legally be limited or excluded.

14. Changes to These Terms

Vibe + Light Photography may update these Terms periodically.

The most current version will be posted through the applicable website or gallery.

Your continued use of the website or gallery after changes are posted constitutes acceptance of the updated Terms to the extent permitted by law.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any dispute arising from use of the website or galleries shall be handled under applicable Michigan law and in a court of proper jurisdiction.

16. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

17. Entire Agreement

These Terms, together with any applicable photography contract, Terms of Sale, Digital Image License, Privacy Policy, and other written agreements between Vibe + Light Photography and the Client, constitute the applicable terms governing the relevant service or transaction. If a separate signed photography contract conflicts with these general website or gallery Terms, the signed photography contract will control with respect to that specific photography service.
